Constitutional Bench is a special type of bench for hearing and deciding cases relating to constitutional disputes and legal questions. The provisions related to the formation of the Constitutional Bench are described in Article 137 of the Constitution of Nepal.
Article 137(1) of the Constitution states that there shall be a Constitutional Bench which consists of the Chief Justice and other four Judges designated by the Chief Justice on the recommendation of the Judicial Council.
The purpose of the formation of the Constitutional Bench is as follows:-
1. To declare the laws inconsistent and conflicting with the Constitution of Nepal as void.
2. To solve the disputes relating to jurisdiction between the various levels of government.
3. To solve the disputes relating to the election of members of the Federal and State Assembly.
4. To solve the matters relating to the disqualification of a member of the Federal and State Assembly.
5. To answer the question of serious matters on constitutional interpretation.
